Terms of Service

Peekavue (“Peekavue,” “we,” “us,” “our”) provides its services (collectively, “Services”) through the website peekavue.com and related apps, subject to these Terms of Service (the “Terms”). “You” and “your” means you as a user of the Services. By accessing or using our Services, you accept these Terms and agree to comply with them, along with our Privacy Policy, Community Guidelines, and (if you are a creator) our Provider Agreement. If you do not agree, do not use the Services.

To report bugs, misconduct, suspicious behavior, or any other breach of these Terms, email support@peekavue.com.

Changes to the Terms

We may amend these Terms from time to time, including when we add features, change fees, or when regulations change. We will make commercially reasonable efforts to notify users of material changes, but you should check these Terms regularly. Continued use after changes means you accept the updated Terms.

Account and registration

You may need to register to access certain Services. You agree to provide and maintain true, accurate, current, and complete information about yourself. Registration data and certain other information about you are governed by our Privacy Policy.

  • You must be at least 18 years old to create an account or use Peekavue.
  • Keep your password confidential. You are solely responsible for activity under your account.
  • If you know or suspect your password has been compromised, notify us promptly.
  • We may suspend or disable your account for breach of these Terms, activity that may damage the Services, infringement of third-party rights, or violation of law.
  • You may delete your account through settings where available, or by emailing support@peekavue.com. Associated data will be deleted or anonymized within a commercially reasonable period, subject to legal retention needs.

Access and use

You may not use our Services:

  • To upload or share content you do not have rights to, or that infringes intellectual property rights.
  • To violate any applicable laws in your jurisdiction.
  • If you are under 18.
  • To copy, modify, reverse engineer, or create replicas of content or the Services except as allowed by law.
  • To determine source code, algorithms, or proprietary techniques in the Services.
  • For unauthorized commercial use of the Services themselves (marketing or leasing the platform) without our consent.
  • To interfere with or damage the Services, servers, networks, or equipment.
  • To harvest or collect information from the Services manually or with automated scripts, except ordinary use of public pages.
  • To impersonate any person or entity, or misrepresent your affiliation.
  • To advertise or offer goods or services that are not expressly authorized on the platform.
  • To promote or aid a competing product by copying our features or soliciting users in breach of these Terms.
  • To promote or engage in criminal activity, or share illegal instructional information.
  • To intimidate or harass any other user.
  • To upload malicious content, files, code, or unauthorized advertising / spam.

We may suspend or terminate accounts, and remove content, with or without notice, at our sole discretion for breach of these Terms, intellectual property rights, or applicable law.

User content

You represent and warrant that you own the rights to content you transmit or upload, or have all licenses and consents needed. By uploading original content (“User Content”), you grant Peekavue a nonexclusive, royalty-free, transferable, worldwide license to host, copy, display, distribute, store, modify (for formatting/delivery), and otherwise use your User Content in connection with operating the Services. You retain ownership of your content.

We may refuse, cut, crop, edit, remove, block, or delete User Content that does not comply with these Terms or our Community Guidelines. We may preserve and disclose content if required by law or to enforce these Terms. Peekavue accepts no liability for content created, shared, posted, or distributed by users.

Payments, refunds, and cancellations

Peekavue offers digital creator content, memberships, paid messages, tips, pay-per-view content, wallet credits, and related digital services. Payments are processed by our payment partner, Whop. By completing a purchase, you agree that access to the applicable digital product or service may be provided immediately.

  • Because Peekavue provides digital products and services, purchases are generally final and non-refundable once access is provided, except where required by applicable law or approved by Peekavue in its sole discretion.
  • You may cancel recurring memberships at any time to prevent future charges. Cancellation stops future billing but does not refund prior charges. Access typically continues until the end of the paid period.
  • We may review refund requests for duplicate charges, technical errors, unauthorized transactions, or failure to receive access. Submitting a request does not guarantee approval.
  • If you believe a charge was made in error, contact support@peekavue.com before initiating a payment dispute or chargeback.
  • Creators earn subject to Peekavue’s platform fee (currently 15% of eligible gross earnings; creators keep 85%) and payout rules described in-product. Fees may change with notice.

Creators

If you publish or monetize content as a creator, you also agree to the Provider Agreement and Record-Keeping statement. Creators must complete identity verification before publishing where required.

Indemnity

You agree to release, indemnify, and hold Peekavue and its affiliates and their officers, employees, directors, agents, and advisors harmless from claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your obligations, representations, and warranties under these Terms, or content you upload.

Exclusion of warranties

NOTHING IN THESE TERMS AFFECTS STATUTORY RIGHTS YOU CANNOT CONTRACTUALLY WAIVE. THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED OR ERROR-FREE, THAT INFORMATION OBTAINED WILL BE ACCURATE OR RELIABLE, OR THAT DEFICIENCIES WILL BE CORRECTED.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEEKAVUE WILL NOT BE LIABLE FOR LOSS RESULTING FROM RELIANCE ON THE SERVICES; LOSS, CORRUPTION, OR INABILITY TO ACCESS CONTENT; CHANGES OR SUSPENSION OF SERVICES; UNAUTHORIZED ACCESS TO YOUR ACCOUNT; YOUR FAILURE TO PROVIDE ACCURATE INFORMATION OR KEEP CREDENTIALS SECURE; OR OTHER MATTERS RELATING TO THE SERVICES. NOTHING EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED (INCLUDING DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FRAUD).

IN NO EVENT SHALL PEEKAVUE’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU TO PEEKAVUE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100) IF GREATER PROTECTION IS REQUIRED BY LAW AND NO SUCH AMOUNT WAS PAID.

Third-party services

Peekavue uses third-party providers (including Whop for payments and Didit for identity verification). Your use of those services may also be subject to their terms. We are not responsible for third-party services we do not control.

Governing law

These Terms are governed by the laws applicable in the jurisdiction where Peekavue operates its primary business, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply. Courts in that jurisdiction will have exclusive jurisdiction, subject to mandatory local law.
